Let's start by explaining what constitutes assault and battery.  Assault is a an entirely separate charge
from battery.  In Florida, assault constitutes of a threat or attempt to cause injury to another.  You
must have the apparent ability to carry on that threat. Furthermore, you must have done some act that
creates a well-founded fear in the other person that violence is imminent.


Battery, on the other hand, is the intentional touching of another without their consent.  The key word
in Florida's definition of battery is "touching".  It is not necessary to hit somebody to be charged with
battery in Florida.  However, hitting, slapping, striking or even spiting on somebody is sufficient to
cause an arrest for battery.


It is important to understand that prosecutors can still go forward with a case even though the alleged
victim recants and does not want to testify against you in court.  Do not fall asleep believing that your
case will automatically be dropped if you know that the alleged victim will not testify against you.
Also, if the judge imposes a no-contact order with the victim, it is important to understand that you
must not have any contact with the victim.  You cannot call, text, or send a third party messanger to the
victim.  More importantly, if you and the victim want the no-contact order lifted, it has to be lifted by
the judge and not by the victim.
